1. Acceptance of Terms
By enrolling in, purchasing, or participating in any service, including but not limited to consultation, workshop, webinar, course, or audit offered by Dr. Biswas or Vitanova Solutions (collectively, “Programs”), you agree to these Terms and Conditions, our Privacy Policy, and the Informed Consent & Data Use Agreement. If you do not agree, please discontinue use of our services.
2. Nature of Services - Educational Purpose Only
All Programs, communications, and materials provided are for educational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment. Dr. Biswas is not acting as a licensed medical practitioner. You should always consult your own qualified healthcare provider before making any medical or lifestyle decisions.
3. Personal Responsibility and Assumption of Risk
Your participation is voluntary. You acknowledge that any dietary, lifestyle, or behavioral changes you make are self-directed and at your own discretion. You assume full responsibility for your choices, actions, and outcomes - including any physical, emotional, or psychological effects. You agree that neither the Provider nor any associated contractors shall be held liable for results arising from your application of the information shared.
4. Limitation of Liability
To the fullest extent permitted by law, the Provider, its employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from: Participation in or reliance on any Program or information provided; Delays, errors, or omissions in content; Any breach, technical failure, or third-party service interruption. If liability is found, it shall not exceed the amount paid for the specific service.
5. Payments, Refunds, and Cancellations
Fees must be paid in full before service delivery unless otherwise stated. Refunds are available within 24 hours of purchase and before any reports are shared with us or analyses have commenced. Once analysis or consultation has begun, fees become non-refundable. If you upgrade to a longer-term Program within 14 days, the full audit fee may be credited toward that Program.
6. Data Privacy and Security
By providing your information, you consent to the collection, use, and secure storage of personal and health data as outlined in our Privacy Policy and Informed Consent & Data Use Agreement. Your data may be stored or transmitted through third-party digital tools (e.g., Google Drive, Microsoft OneDrive, Gmail, Outlook, WhatsApp, Zoom, Notion, etc.). We take reasonable precautions to protect your information but cannot guarantee absolute security. You acknowledge and accept this residual risk.
7. Confidentiality and Limited Sharing
Your personal health information will remain confidential and shared only: As required by law; With internal staff or subcontractors for administrative purposes; or In anonymous or aggregated form for educational or research purposes. You may request access, correction, or deletion of your data except where retention is legally required.
8. Communication Consent
By enrolling or submitting your details, you consent to receiving communications via, but not limited to, email, phone, SMS, or WhatsApp for scheduling, education, and program updates. You may opt out of promotional messages at any time.
9. Intellectual Property
All materials, frameworks (including Exposome Realignment and related modules), trademarks, and content provided by the Provider remain the exclusive intellectual property of Dr. Biswas / Vitanova Solutions. You may not copy, reproduce, or distribute these materials without written consent.
10. Jurisdiction and Dispute Resolution
These Terms are governed by the laws of the Republic of India. Any disputes shall first be addressed amicably; if unresolved, they shall be referred to confidential arbitration in Bangalore, India, in accordance with the Indian Arbitration & Conciliation Act 1996. All proceedings and outcomes shall remain confidential.
11. Testimonials and Case Studies
You may voluntarily share feedback or testimonials. By doing so, you grant us permission to use anonymised excerpts for marketing or educational purposes unless you explicitly request otherwise in writing.
12. Program Modifications and Availability
We reserve the right to modify, pause, or discontinue any Program or its pricing at our discretion, without prior notice, while honouring all active commitments already paid for.
13. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining sections remain valid. These Terms, together with the Privacy Policy and Informed Consent & Data Use Agreement, constitute the entire understanding between you and the Provider.
